Motus Select and Motusbid Terms and Conditions – Main Page

Sell Your Car application/functionality:

1. You have elected to ask Motus Select (a division of Motus Group Limited) to value your vehicle for you to decide whether you want to sell your vehicle to Motus Group.
2. If you elect to receive an indicative price for your vehicle, you must complete the details of your vehicle truthfully.
3. Motus Group is not obliged to provide you with a quote, and in certain cases may decline to do so, for example if your vehicle falls outside our buying range, or it cannot service your location.
4. When you elect to use the “Sell Your Car” function, you understand that a representative from Motus Group will contact you to discuss and/or obtain further information relevant to your vehicle.
5. You understand that Motus Group has not inspected your vehicle to determine the condition thereof. Any indicative price is therefore strictly subject to inspection and verification of various factors described below. Such indicative price is therefore non-binding until a representative has inspected the vehicle.
6. The following is a non-exclusive list of factors determining the value of a pre-owned vehicle:
   • Year model (as determined by the NATIS document as the year of first registration);
   • Mileage;
   • Physical condition (including factors such as the condition of the paint, body, tyres, interior and functioning of accessories);
   • Service history;
   • Accident damage;
   • Other cosmetic work;
   • The factors as detailed in clause 7.

7. You acknowledge that once you receive a final value after the physical inspection, such value is valid for a period of 48 (FORTY EIGHT) HOURS from date of inspection and is furthermore subject to:
   • Accurate information provided when completing your vehicle’s details, including the year, make and model of the vehicle and warranty initiation date; and
   • The details in the Motus Select Vehicle Valuation match the motor vehicle and its condition in all respects including the engine and VIN numbers; and
   • The engine and VIN numbers match the manufacturer’s original numbers; and
   • The vehicle does not have any clear or concealed structural damage; and
   • The odometer reading correlates with the actual distance covered and has not been altered or tampered with and that less than 1 000 kilometres have been added thereto since you provided the information contemplated herein; and
   • You being the owner of the motor vehicle and am entitled to pass transfer; and
   • The vehicle has not been changed or altered in any way (including installation/fitment of performance enhancing equipment); and
   • The vehicle is not a grey market import, a stolen vehicle, or a rebuilt vehicle; and
   • The vehicle is mobile; and
   • You recorded the accident history (and any other repairs to the vehicle) and declared such; and
   • The vehicle is registered and classified as new or used as per the applicable South African licensing legislation; and
   • The vehicle is not subject to any further lien or pledge whatsoever and that, save as detailed above, no third party has a stronger right, title or claim of ownership or possession of the vehicle; and
   • The vehicle’s license is up to date and all taxes relating to the motor vehicle have been paid; and
   • All E-tolls and traffic violations have been paid;
   • The vehicle has not been previously written off and salvaged.

8. You acknowledge that if it is determined at a later stage that the above was untrue, then and in such event, you hereby irrevocably undertake to pay upon demand any damage and loss of profit suffered by Motus Group, howsoever arising.
9. You hereby consent to Motus Group validating your personal information and vehicle particulars and obtaining the following information/documentation: 
   • A copy of the NATIS document;
   • A copy of the license disc;
   • Settlement figure on the vehicle if subject to finance; and
   • A copy of your driver’s license.

10. You hereby warrant the factual items which Motus Group will rely on when it sells the vehicle to another consumer. You understand that if any of the disclosures are false and/or that you failed to disclose a defect or hazard in the vehicle, you hold Motus Group harmless against any damage or loss that it or the next purchaser of the vehicle may suffer as a result thereof.
11. You warrant that should you described the vehicle as having a full-service history, that you adhered to the service terms and conditions as required by the Manufacturer in the service/maintenance booklet of the vehicle and that all warranties, service plans and maintenance contracts are valid and in place.
12. In addition to the common law rights accruing to Motus Group by virtue of your warranty against vindication, you hereby undertake to pay upon demand all damages and loss of profit suffered by Motus Group arising from vindication of the dealership or its successor/s in title.
